Hi guys,  got a small issue.  i have already paid my gst/vax with jauce. 

 

now DHL are holding my item until i pay them duty and gst.  i told them i have already paid and have proff and they dont care and say until i pay them they wont release the item.  

 

got any advice apart from yelling?

My choice would be to pay first and then file an objection afterwards. 

The longer it's in their hands, the higher the chance of them losing it or sending it back.

I think DHL demands to pay import duties and taxes
You don't say which country you are from
But in general - if you don't want to pay VAT or similar taxes in the country where you buy, then you have to deal with Jauce
Honestly - I've always paid full price in Japan and then taxes in my country when importing
Only if Japan and your country had a bilateral agreement preventing double taxation - which I doubt - then your complaints are justified

I had no problem getting a deduction of 10% (Japanese consumption tax rate) from the listed price and expect a charge of 7% when importing a 100+ year old antique into Germany via EMS. The dealer seems to know what he's doing and will use the HS tariff suggested by Darcy. This will be my first nihonto purchase from Japan so I hope all goes smoothly. Its a fairly low value blade (by general Koto standards) so is a bit of a test piece.

That pretty much sums up my experience with DHL. Some people swear by them, but they are rather Gestapo about duty fees and hit me hard on a special sake flask that was mislabeled by the sender.

 

At that time, they also charged some ridiculous processing fee to make a claim against the duties that I had to pay them.

It was like $75, which was a significant chunk of the $95-100 or so in bogus duties I had to pay on a duty free piece of artwork.

Yes - an agreement on the reduction of consumption tax can be reached with private company sellers (also not always for various reasons)
But I've never even tried deducting Japanese consumption tax on purchases from Buyee. I have never shopped at Jauce

Yes, Jauce is a particular case. Its a little like Ebay and their International Packaging/Shipping scheme. I've never bought anything through Jauce (too much of a minefield for Nihonto and related items) so unsure if double taxation is something that has to be considered in the final calculations.

i have had swords delivered by DHL (international) and i always get a tax bill. I pay it. Not so happy but that is the way it is. Doesn't matter how the sender describes the contents....  If i get a sword delivered through USPS i get no tax bill.

I don't know how DHL accepts swords to begin with. I tried sending swords with DHL from Australia to USA  a few times and was told DHL doesn't accept weapons/ sharp implements.

It's Australia mate. Surprised they didn't object to the foreign air inside the parcel and confiscate that. :-?
Good luck. I expect they will fumigate it and hit you with a hefty charge for that.

DHL like Fedex or CHRONOPOST (France) and others big logistics companies have their own customs clearance services. They earn a very small percentage of money on each item their customs services clear. That is why they always/often charges you import taxes.

 

Public companies like USPS in the USA or LA POSTE in France do not care to make profit, so they rarely charge you import taxes if you have already paid them on Ebay or others sellers.

 

It is a known problem here in France that has been published several times in the press, but nobody seems to care enough to make things change.

I really do care...but have no clue how to solve this issue. 

 

Must of the time you pay 20% ( instead of 5% on antiques) online and double pay 20% plus fees to get custom process done by chronopost, FedEx or DHL. I wrote letters, waste time with SAV and online reclamation... no way to get my money back!

Whish I live in SA and get a gun..

I don't think they could pay me enough to live in South Africa!    NO WAY JOSE!

 

With all the Gun Control freaks running the US Government claim the USA is the most dangerous country to live in!   That is so rich, especially; like all that goes on countries in Africa where Cannibalism is still practiced in parts of some cultures General Butt Naked of Liberia,  or the Boko Haram of Somalia who kidnapped all the 2000 girls who were all raped and half were eaten. ( I have photos that those Somalian's took of themselves having a cookout ) Then to Mexico which is run by the Drug Organizations.  Because of the overkill rules made by legislators that hinder LEGAL ownership has made it all the more easier for Criminals to commit more crimes knowing full well nothing will happen to them.  Now they have imported them here WITHOUT VETTING!!!

Since DHL is the German national post carrier, what are locals experiences when importing nihonto into the country? If the appropriate HS tariff is on the Waybill and documentation  included to confirm the age, do owners still have to fight for the correct 7% tax to be applied?

I am neither Political party, and never have voted. I was in between my Laptop at home( ended up having to run back and forth several times )  had to quickly run off to pick up my daughter from work a few miles from home, ended up being stuck even longer than usual so while waiting in the parking lot and went on my cell phone and with it acting so funky flashing on and off ( Maybe that was anti seizure meds...ooorrr the Peyote tea...but hey who can tell these days ? Never heard of this "Pay the duties and taxes to the shippers before shipping" thing before.
I always assumed everywhere was like here. You purchase the item, and pay for shipping. When it gets to the destination country, the shipper (be they UPS, DHL or Fedex) submits to customs who assesses the parcel and you get a bill from the shipper for the vat/duties and their small fees. Pay that and they deliver. They clear it through customs.
Paying the duties etc before shipping sounds like an odd way to work, considering customs can assess duties etc as they see fit, and then you may have to object if the wrong tariff code was used.
I'd question why any shipper is asking for any of those fees upfront, since it's their job to clear it through customs, and take the fees and pay for them.
Bit like the eBay Global Shipping program I guess, where they want all of those fees up front, which is why I refuse to use it.

Amazon do something similar when an item is sourced outside the local amazon site. eg from amazon.com instead of amazon.de. There is an extra fee bundled into the delivery costs to cover customs clearance and taxes.

I’ve had the same experience with ,UPS only last week. I had my sword held by UK Borderforce from November 23 and finally got it delivered in July. This was after paying the duty of £188. UPS rang me left me a voice message and also sent me mail 

chasing duty payments . After I Imailed them telling them I had already paid. This was last week , I have not received a reply.

 Today , I’m going to pick it up from 😜 the sharpener. 🍻🎉

German customs are like ohh ok it’s 7% for antiques (outdated now as far as I know) but the computer says 21% so it’s 21% you will have to pay. 
 

If you have a business you only have to pay 30% of the 21%, so around ~7%. 
 

Fun starts when you tell them that they break international law when they want tax from you for the item because you have a museum.

There is written that museums don’t have to pay tax for cultural goods from other UNESCO states.

(this is how big museums deal with this stuff tax free) 


More fun part: 

There is no prescribed legal form for establishing a museum in Germany 

 

So maybe you own an online museum 

 

Actually I have not tried this but I think it should work :laughing:


some custom offices have a problem with this unesco deal when the items are not exhibited and want money years later for example in Switzerland
